A PENSIONER who was found to have breached his sexual harm prevention order (SHPO) in Bangor has been sent back to jail.

Paul Davis, 76, of Ty Newydd Bail Hostel, Bangor, was sentenced to four months’ imprisonment at Caernarfon Crown Court today (May 31).

He had previously admitted breaching the SHPO at an earlier hearing in the magistrates’ court.

Prosecuting, Elen Owen told the court that Davis’ 10-year SHPO was issued on December 17, 2021 after he had been convicted of numerous sexual offences.

These included sexual assault of a child, engaging in sexual activity in the presence of a child, and possession of extreme pornographic images.

On that date, he was jailed for 57 months at Swansea Crown Court.

Shortly after being released on licence, a police officer met Davis for the first time at Ty Newydd Bail Hostel on May 1, where he was seen by her to have an iPhone.

The following week, it became evident to police that a Facebook account in the name of “Brian Davis” was in the process of being made by the defendant.

His SHPO prohibits him from using a mobile phone with the capacity to access the internet, and to create a Facebook account in a name other than his own.

Davis was arrested on May 8 and was recalled to prison.

Representing Davis, Paul Smith said his client’s explanation is that, although he was aware of the SHPO, he did not have a written copy of its terms.

Mr Smith said the breach has had a “catastrophic effect” on Davis, a former mechanical engineer, and has “severely hampered his re-introduction to the community”.

“It’s very sad to see a man who, until very late in his life, had an unblemished record,” Mr Smith added.

Sentencing, Recorder Wyn Lloyd-Jones told Davis: “It saddens me to have to sentence a man of 76 for serious offences such as this.”
